Borrowing Terms

These Borrowing Terms govern your use of the Library of Things borrowing facility (the Borrowing Service) provided through the platform operated by Jogiton Online Limited, a company registered in England and Wales under number 15010475, whose registered office is at 14 Latham Close, Bredbury Industrial Estate, Stockport, Cheshire, SK6 2SD (we, us, the Operator). These Borrowing Terms supplement our General Terms & Conditions, Acceptable Use Policy, Privacy Policy and Cookie Policy. Where there is any conflict on a borrowing matter, these Borrowing Terms take precedence. By reserving, collecting or borrowing any item through the Borrowing Service, you agree to be bound by these terms. If you do not agree, you must not use the Borrowing Service.

We may change these terms from time to time. Changes take effect when posted on the platform. The terms in force when a loan begins apply to that loan until it ends. We will give reasonable notice of major changes.

The Borrowing Service lets students lend items to, and borrow items from, one another. Each loan is between the person or body lending the item (the Lender) and the person borrowing it (the Borrower). We provide and operate the platform that connects Lenders and Borrowers and facilitates loans, but we do not own the items and are not a party to any loan. Lenders may include individual students and any provider offering a curated range of items (for example an "Essentials" range) through the Borrowing Service. A Lender may apply its own additional terms to its items, as set out in clause 8.

Definitions

1. Eligibility

1.1 The Borrowing Service is available only to current, enrolled University of Manchester students with a verified university affiliation. We may require you to verify your status (for example, by university email or student card) when you register and when you collect an item.

1.2 You must be aged 18 or over to use the Borrowing Service.

1.3 You must provide accurate registration and eligibility information and keep it up to date. We may refuse or suspend access where information is false, out of date, or cannot be verified.

1.4 Borrowing rights are personal to you. You must not borrow on behalf of anyone else, and you must not pass a borrowed item to anyone else.

2. How borrowing works

2.1 You browse and reserve an available item through the platform. A reservation is confirmed when the Lender accepts it.

2.2 Collection. You collect the item as arranged, from the Lender or a designated collection point. You may be asked to show your student card and to provide a collection code. The item's condition is recorded at collection, including photographs where appropriate.

2.3 During the loan. You are responsible for the item from the point of collection until its return is confirmed under clause 4.4. You must keep it safe, use it only as intended, and follow any safety or care instructions provided with it.

2.4 Loan limits. The Loan Period for an item, and any limit on the quantity that may be borrowed or on renewals, are set out in that item's listing and shown to you before you reserve. Different items may have different limits.

2.5 Renewals. You may request to extend a loan before its Due Date. Extensions are granted at the Lender's discretion and are not available where another user has reserved the item or where the item is already overdue.

3. Late returns

3.1 We will send you reminders before and on the Due Date.

3.2 If an item is not returned by its Due Date it becomes overdue. While you hold an overdue item, your account will be flagged and your ability to borrow further items will be suspended until the item is returned or otherwise resolved.

3.3 If an item remains overdue for more than 14 days, we may treat it as lost, and the loss provisions in clause 4 will apply.

3.4 We do not charge a daily late fee. Persistent or repeated late returns may lead to suspension or barring under clause 7.

4. Damage, loss and returns

4.1 You must return each item by its Due Date and in the same condition as at collection, allowing for fair wear and tear.

4.2 You are responsible for the loss of, or any damage beyond fair wear and tear to, an item while it is in your possession, however that loss or damage is caused, except to the extent it is caused by a fault present in the item when it was issued to you.

4.3 You must report any damage, fault or loss as soon as you become aware of it. If you believe an item is unsafe or faulty, do not use it - stop and report it to us. You must not attempt to repair an item yourself.

4.4 Returns. On return, the item's condition is checked against the record made at collection. The loan ends, and your responsibility for the item ends, only when its return is confirmed. You should keep your return confirmation.

4.5 Charges for damage or loss. Where an item is lost, or damaged beyond fair wear and tear, you agree to pay either the reasonable cost of repair, where the item can be economically repaired, or the Replacement Value, where it cannot be repaired or is lost. Any such charge reflects the genuine cost and is not a penalty. You will be told the basis of any charge before it is applied and given the opportunity to query it.

4.6 Where a deposit is held under clause 6, it may be applied against any amount properly due under this clause, and any balance will be refunded to you.

5. Your responsibilities and prohibited use

5.1 You must use each item only for its intended purpose and in line with any instructions provided; keep it secure; not modify, dismantle or repair it; not sell, hire, lend or otherwise transfer it to anyone; and return it on time, clean and in acceptable working condition.

5.2 You must not use any item for any unlawful, dangerous or commercial purpose, or in any way that breaches our Acceptable Use Policy.

5.3 Some items carry age, safety or competency restrictions. Where a restriction applies, it will be shown before you reserve, and you must meet it before borrowing.

5.4 Conditions of use (tags). An item's listing may set out specific conditions of use, which may be shown as tags. These may include dietary, religious, hygiene or allergen-related conditions - for example, a kitchen appliance tagged for use only with halal-safe ingredients. Where an item carries such a condition, by borrowing it you agree to comply with the condition and to return the item in a state consistent with it. We do not verify, monitor or police compliance with these conditions, and neither we nor any other user guarantees that an item has only ever been used in accordance with them. Any reliance you place on a tag or condition, including in relation to dietary, religious or allergen requirements, is at your own risk.

6. Deposits and charges

6.1 A deposit is not required unless an item's listing or the Lender's Additional Terms specify one. Where a deposit applies, the amount is shown clearly before you reserve.

6.2 Where a deposit applies, it is taken at or before collection and refunded after the item is returned and confirmed to be in acceptable condition, less any amount properly due under clause 4.

6.3 Any charges due (including repair charges and Replacement Value) may be collected through the payment method on your account or invoiced to you. Payment is made by you through the platform's payment process.

7. Suspension and barring

7.1 We may issue a warning, suspend your access, or permanently bar you from the Borrowing Service, acting reasonably, if you:

7.1.1 fail to return an item;

7.1.2 are repeatedly or seriously late in returning items;

7.1.3 cause loss of or damage to an item through misuse or neglect;

7.1.4 lend, sell or transfer a borrowed item to anyone else;

7.1.5 use an item for a prohibited, commercial or unlawful purpose;

7.1.6 provide false eligibility or identity information;

7.1.7 abuse, threaten or harass our staff or other users;

7.1.8 act fraudulently; or

7.1.9 fail to pay charges properly due.

7.2 Any action we take will be proportionate to the conduct concerned. Serious matters, including fraud, theft, safety risks or unlawful use, may result in immediate and permanent barring and, where appropriate, referral to the University or to the police.

7.3 Suspension or barring does not remove your obligation to return any item you hold or to pay any charge already due.

7.4 Lender-level restriction. In addition to any action we take, a Lender may, through the platform, prevent a Borrower from borrowing the Lender's own items. A restriction imposed by a Lender applies only to that Lender's items and does not affect the Borrower's ability to borrow other items through the Borrowing Service. A Lender must not impose such a restriction in any way that is unlawful, including unlawful discrimination, or otherwise in breach of our Acceptable Use Policy.

8. Lenders, their items and additional terms

8.1 Our role. Each loan is between the Lender and the Borrower. We provide the platform that connects them and facilitates the loan, but we do not own the items, do not inspect, test or guarantee them, and are not a party to any loan. Borrowers and Lenders deal with each other directly and must each use their own care and judgement.

8.2 Lender obligations. If you list an item to lend, you confirm that you own it outright or otherwise have the right to lend it, that it is safe and fit for the purpose you describe, and that your description of it is accurate. You are responsible for any safety checks appropriate to the item and, where relevant, for ensuring it is clean and fit for use between loans. You must not list any item that is prohibited under our Listing Rules or Acceptable Use Policy, or any item that is unsafe, subject to a product recall, or subject to a legal restriction you do not meet.

8.3 Lender's Additional Terms. A Lender may apply its own additional terms to its items - for example a deposit requirement, specific care, hygiene or usage conditions, or a shorter loan period. Any such Additional Terms are shown before you reserve, and by borrowing the item you agree to them. They apply only to that Lender's items and supplement these Borrowing Terms. A Lender's Additional Terms may not reduce your statutory rights, or override these Borrowing Terms or our Acceptable Use Policy on matters of eligibility, lawful use, safety or our role. Where a Lender's Additional Term genuinely conflicts with these Borrowing Terms, these Borrowing Terms prevail.

8.4 Lending fees. A Lender may charge a fee for lending an item. Any lending fee is set by the Lender and shown to you before you reserve, and is payable as part of arranging the loan.

8.5 Risk and disputes. The Borrower is responsible to the Lender for the loss of, or any damage beyond fair wear and tear to, an item, on the basis set out in clause 4, from collection until its return is confirmed. We do not guarantee the condition, safety or return of any item, and we are not responsible for any amount owed between users. Where we offer a mediation or deposit-holding feature, we provide it only as a facilitator. Disputes about a loan should first be resolved directly between the Borrower and the Lender. We may offer a mediation route through the platform but are not obliged to resolve disputes and are not a party to them. The general release and liability provisions of our General Terms & Conditions apply.

9. Liability

9.1 Items are provided by Lenders, not by us, and are made available on an "as is" basis. You use borrowed items at your own risk and are responsible for using them safely and competently.

9.2 To the fullest extent permitted by law, we are not liable for any loss or damage arising from your use of a borrowed item, or arising between users, except where it is caused by our own negligence or our breach of these terms.

9.3 Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded or limited under applicable law, including your rights as a consumer.

9.4 You are responsible for, and will indemnify us against, any loss, damage or claim arising from your misuse of an item or your breach of these terms, including any harm caused to a third party.

10. Data protection

10.1 We process your personal data, including your borrowing history, eligibility verification and any charges, in line with our Privacy Policy and applicable data protection law. We keep borrowing records in order to operate the service, manage returns and charges, and prevent misuse.

11. General

11.1 If any provision of these terms is found to be unenforceable, the remaining provisions continue in full force.

11.2 We will not be liable for any failure or delay in performance caused by circumstances beyond our reasonable control.

11.3 These terms, and any dispute or claim arising from them, are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.

12. Trial period

12.1 During the current trial of the Borrowing Service, all payments - including any lending fee, deposit, or charge for repair, Replacement Value or otherwise - are handled directly by the Lender, and not through the platform's payment process. The Lender is responsible for collecting, holding and refunding any such amounts, and any dispute about a payment is to be resolved directly between the Borrower and the Lender.

12.2 This clause applies for the duration of the trial and prevails over clause 6 to the extent of any conflict during that period.
